Please read and scroll through the following policies before completing your booking.
By booking a session, you agree to the following and to the Facility Rules posted on-site and at booking (incorporated into this Agreement): - Assumption of risk: I understand golf simulator activity involves inherent risks of injury — including being struck by a club or ball, strains, falls, or equipment malfunction — and I voluntarily assume those risks. - Unstaffed facility: I understand The Swing may operate unstaffed. In an emergency I will call 911 myself, and I will immediately report any injury, unsafe condition, or equipment damage using the contact info posted on-site. - Facility Rules: I agree to follow all Facility Rules posted on-site and at booking, including rules on alcohol, minors, equipment use, and booking/overtime, and I understand I'm financially responsible for damage caused by my misuse or violation of those rules. - Release of liability: I release The Swing GC LLC, its owners, employees, and agents from liability for injury, death, or property damage arising from ordinary negligence, to the fullest extent allowed by California law. This does not release gross negligence or willful misconduct, which cannot be waived under CA Civil Code §1668. - Indemnification: I agree to indemnify and hold The Swing harmless from claims arising out of my use of the Facility, to the extent permitted by law. - Medical authorization: I authorize The Swing or emergency responders to obtain medical treatment for me if needed, at my own expense. - Minors: Guests under 16 must be supervised by an adult per Facility Rules. Guests under 18 cannot accept this Agreement themselves — a parent or legal guardian must complete booking and acceptance on their behalf.
